User Consumer Acknowledgement & Authorization Agreement (or "Agreement") for the “Investment Referral Program” offered by Real Estate Hard Money.

This Agreement describes the terms and conditions applicable to the use and customer participation in the “Investment Referral Program” services offered by Real Estate Hard Money. You must read, agree with and accept all of the terms and conditions contained in this Agreement and the Privacy Policy, which include those expressly set out below and those incorporated by reference. We may amend this Agreement at any time by posting the amended terms and conditions posted on the Real Estate Hard Money web site, www.rehardmoney.com and all amended terms will be effective immediately.

Eligibility

The services of Real Estate Hard Money are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. These services are not available to any person under the age of 18 or temporarily or indefinitely suspended Real Estate Hard Money customers. Customer privileges may not be transferred to any other party. Any customer registering as a business entity is the representing authority to bind the entity to this Agreement. The privileges of a customer will be temporarily or indefinitely suspended if the customer provides falsified information or tries to commit fraud in any way.

Privacy

Real Estate Hard Money uses the personal information of its customers, provided by its customers, to facilitate its customers’ requests of services, such as entails but not limits the matching of property quote and funding requests with agents, licensed loan officers and banks, which may be able to offer funding within the guidelines of the requested scenario. The information provided to Real Estate Hard Money by its customers will be made available to agents, licensed loan officers, and banks participating in our “Investment Referral Program” solely for the purpose of fulfilling the customer's request for service such as entails but not limiting the request for assistance in obtaining funding, such requests are fulfilled by Real Estate Hard Money by engaging and acting as a referral agent. All agents, licensed loan officers, and banks participating in the Real Estate Hard Money “Investment Referral Program” have certified to the above and are legally bound to only use the information that customers of the Real Estate Hard Money “Investment Referral Program” provided for this reason.

Real Estate Hard Money will not sell or rent the personal information of its customers to third parties for their marketing purposes without their customer's explicit consent. Real Estate Hard Money stores and processes the information of their customers on computers located in the United States that are protected by physical as well as technological security devices.

Real Estate Hard Money “Investment Referral Program” may use personal information about their customers to improve marketing and promotional efforts, analyze service usage, improve content and product offerings, and customize the services to provide their customers with a smooth, efficient, safe and customized experience while using the services.

All customers must agree that Real Estate Hard Money may use their personal information to contact them, deliver the information which they requested and referred or transfer their personal information to any participating agent, licensed loan officer or bank. By accepting this Agreement and Privacy Policy, members expressly agree to receive this information and actively participate in the referral program.

General

This Agreement is governed in all respects by the laws of the United States as such laws are applied to agreements entered into and to be performed entirely within the boundaries of the United States between United States residents. Real Estate Hard Money does not guarantee continuous, uninterrupted or secure access to their services, and operation of the Real Estate Hard Money “Investment Referral Program” may be interfered with by numerous factors outside of the control of Real Estate Hard Money. If any provision of this Agreement is found invalid or unenforceable, such provision will be struck and the remaining provisions will be enforced. Real Estate Hard Money “Investment Referral Program” retains the right to refuse service on or terminate user account at any point if the program is being used improperly (i.e., false information is provided). Program participation is limited to acquiring nonowner occupied investment properties via hard money funding and is not a guarantee to receive funding on any particular property as not all properties will fit into general hard money parameters.

Security

All customer information of the Real Estate Hard Money “Investment Referral Program” is stored on Real Estate Hard Money servers located in the United States. Real Estate Hard Money use procedural and technical safeguards to protect the personal information of their customers against loss or theft as well as unauthorized access and disclosure to protect your privacy, including encryption, "firewalls" and Secure Socket Layers. Real Estate Hard Money treats data as an asset that must be protected against loss and unauthorized access. Real Estate Hard Money employs many different security techniques to protect such data from unauthorized access by users inside and outside the company. However, "perfect security" and “perfect performance” does not exist in communications via the Internet.

Fees and Services

The Real Estate Hard Money “Investment Referral Program” is an initial six (6) month customer privilege and is designed to help our customers obtain hard money funding for business to business real estate investments. The one time start up investment for the “Investment Referral Program" is $997.00. Thereafter, customers may choose at their discretion to continue to use our services for $197.00 for each subsequent six (6) month period. Real Estate Hard Money “Investment Referral Program” is a referral program and the program purpose is to provide customers our hard money lender network access as well as a Business Development Consultant mentor. Customers may be required to complete an application with each participating entity for each piece of real estate they strive to acquire. Costs that will incur in and through the process of acquiring real estate such as appraisals, attorney fees, title search fees, points and any other incidental closing costs are not included in the customer privileges or program. Typically, a hard money borrower will need approximately 8% to 10% of the loan amount for points and closing costs and 6 months interest only payments in liquid reserves. In order to receive the $400.00 broker credit, the loan amount needs to be $100,000 or greater. All requests for broker credits and/or refunds need to be submitted to Real Estate Hard Money via certified mail. In addition, customers may be required to submit pictures of subject property, construction analysis, construction repair estimates or bids, asset statements, 1099 W-2 or Year to Date Profit & Loss statements, and exit strategies. Real Estate Hard Money is not a mortgage banker or private/hard money lender in any state.

Limits of Liability / Disclaimer of Warranty

The creators, authors and publisher of the educational materials included in the Real Estate Hard Money “Investment Referral Program” and the accompanying referral processes and entities, have used their best efforts in preparing this program.
